Following the intense public consultation process carried out since the end of 2009 and with the major setback after the court%7s decision in the Comcast case, on December 21st 2010 the FCC adopted the elements that constitute its solution to the famous problems involving network neutrality. This solution, which is much less ambitious than the one raised in its consultation and based on a principle of transparency and a nuanced principle of no undue discrimination to be applied only to fi xed broadband networks, is nothing more than an intermediate solution that does not close the debate since it fails to resolve its underlying structural problems.
